These Terms and Conditions ("Terms") govern the use of Elite Marine’s yacht brokerage services ("Services"). By engaging in any transaction with Elite Marine, you agree to abide by these Terms. Please read them carefully.
Scope of Services:
Elite Marine acts as a broker to facilitate the sales and purchase of yachts
We connect buyers, sellers, and charterers and assist in negotiations, documentation, and transactions.
Representation:
Elite Marine acts solely as a broker and does not own any yachts listed unless explicitly stated.
We do not guarantee the accuracy or completeness of yacht listings. Buyers and charterers are responsible for verifying all information.
Fees and Commissions:
Fees and commissions are outlined in separate agreements between Elite Marine and clients.
Commissions are due upon the successful completion of a transaction as agreed upon in writing.
Confidentiality:
Elite Marine respects the confidentiality of client information.
Information shared during the brokerage process will be treated with the utmost confidentiality, except as required by PDPA
Disclaimer of Warranties:
Elite Marine makes no warranties, express or implied, regarding the yachts listed.
We do not guarantee the condition, seaworthiness, or suitability of any yacht for a specific purpose.
Limitation of Liability:
Elite Marine shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our Services.
Our liability is limited to the extent permitted by law.
Indemnification:
Clients agree to indemnify and hold harmless Elite Marine from any claims, damages, or losses arising from their use of our Services.
This includes but is not limited to disputes between buyers and sellers.
Governing Law and Jurisdiction:
These Terms shall be governed by and construed in accordance with the laws of Singapore.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Singapore.
Amendments:
Elite Marine reserves the right to amend these Terms at any time.
Amendments will be effective immediately upon posting on our website or other notification methods.
Severability:
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement:
These Terms constitute the entire agreement between Elite Marine and clients regarding the use of our Services.
